NEWSSLIDE PRIVACY POLICY:

 

1.        Introduction

 

NewsSlide is committed to protecting the privacy of your personal information. This Privacy Statement provides information explaining how NewsSlide collects, uses, and shares information collected from those who use the app, as well as the choices you have regarding our use of this information. Acceptance of this Policy is a condition of using NewsSlide; please read the entire Policy before using, or submitting information to, the Service.

 

Third Parties

 

This Privacy Policy addresses the collection, use, and disclosure of your information only by NewsSlide. Through the NewsSlide app, you may have access to third-parties (including for example vendors and payment processors) that have different privacy policies and practices. If you choose to access those third- parties, be aware that that website’s privacy policy will also govern how your information is collected, stored, and used. We encourage you to carefully read and review the policies and practices of the websites you visit.

 

Definitions

 

To help you better understand our privacy policy and our practices, here is what we mean when we say:

 

App: NewsSlide is an app, in other words, software that you download onto an internet-enabled device. The software both runs NewsSlide  and also allows the collection of information. That information is stored on the device not with NewsSlide; unless you expressly approve otherwise, NewsSlide does not collect or otherwise collect the information, but does access information stored on your device when you use the app. NewsSlide will use any personal information solely for the purpose of delivering services through the app.

 

Because information is stored on your device, it is important that you maintain the  security of that device. If you allow others to access your device, they will also have  access to the app and may have access to your information.

 

In addition, through the app you may access third-parties (including without limitation vendors and payment processors). Those third-parties may collect and use your information. Those interactions will be governed by the terms and conditions provided by the third-parties, including without limitation any applicable


privacy policies. In addition, when you download the app, the Apple or Android store may gather your personal or device information. That will be governed by the terms and conditions governing your use of the store and the relevant operating system.

 

Account: You can use NewsSlide without creating an account; however, an account is necessary to enable certain enhanced NewsSlide functions (for example, saving content and accessing information across multiple devices associated with a single account). When you create and later log into an account, you enter certain personal information about yourself. NewsSlide will retain that information and use it solely for the purpose of enabling those enhanced functions.

 

Personally Identifiable Information (PII): Information that directly identifies or reasonably can be used to figure out the identity of a user, such as your name, address, phone number, and email address. Personal information does not include information that has been made anonymous so that it does not identify a specific user.

 

As noted above, NewsSlide collects and holds only that information you voluntarily provide in setting up your account. Other information is stored on your device and is made available to NewsSlide when you use the app.

 

2.                          How Your Information is Collected and Used

 

NewsSlide may collect information from and about you in two ways: 1) information that you voluntarily provide; and 2) information that is linked (whether via social media or otherwise) to the information you voluntarily share with NewsSlide.

 

As noted above, third-parties may collect information from you in three ways: 1) information that you voluntarily provide; 2) information collected automatically when you visit or otherwise interact with those third-parties; and 3) information that you indirectly share though supplying your e-mail or social information.

 

NewsSlide’s collection of customer information is limited. If you do not want to have ANY information collected about you (whether by NewsSlide or third parties), you should disconnect from NewsSlide and then close and delete this app.

 

(a)  Information You Provide

 

NewsSlide collects information, including personally identifiable information, that you provide to us when you create and access an account. For example,


you may be asked to provide your email addresses, zip or postal code, first and/or last name.

 

This personally identifiable information may be used:

 

·      to respond to your requests;

·      to contact you with information that might be of interest to you, for analytical and research purposes;

·      to contact you for advertising purposes;

·      to develop and improve our programs, services, and content;

·      to enforce this Privacy Statement and the other rules about your use of the Website;

·      to protect our rights or property;

·      to protect an individual’s health, safety, or welfare; and

·      to comply with a law or regulation, court order, or other legal process.

 

(b)  Advertising & Analytics Services

 

NewsSlide and other parties may collect or purchase information that is available via third-party marketing and social media companies based on or otherwise related to the information that you have voluntarily entered or otherwise provided. This information may be used to:

 

·      Develop personalized programs, services, or content;

·      Customize the information or services that are of interest to you;

·      Tailor our communications to you;

·      Create and improve NewsSlide features

 

In addition and as noted above, NewsSlide gives you access to various third- party services and vendors. While third-party access to and use of your personal information will be governed by their respective privacy policies, you should be aware that these third-parties may use different technologies to collect information about you and your use of the app; this information may be used to analyze data, determine the popularity of specific content, and   deliver advertising based on your interests.

 

(c)   Information Collected Automatically

 

Third parties may automatically collect information about your device and your visit, if you visit or otherwise utilize their services. Among other pieces of information, this includes information about your device, the different vendors accessed, the date and time you used the app, and your approximate


location based on your IP address. You agree and understand that, by using or otherwise accessing third party resources, you will be subject to the  policies and practices of those third parties; that NewsSlide is not responsible or liable for the actions of those third parties; and that any collection and use of this information is pursuant to those third parties’ privacy policies.

 

3.   How Your Information Is Shared

 

NewsSlide may disclose your personally identifiable information in the following contexts:

 

Consent

 

NewsSlide will only disclose your information to third parties with your consent. We obtain such consent in writing, or online through “click-through” agreements. In addition, you specifically grant consent to share any information you supply upon setting up or otherwise using your NewsSlide account.

 

Vendors, Payment Processors, and Other Third-Parties

 

Your personally identifiable information may be shared with other companies as is necessary to carry out NewsSlide transactions, including without limitation with payment processors, vendors, and shippers. NewsSlide may also provide the information to third-parties that perform services on our behalf that are associated with the NewsSlide app (for example, companies that manage, maintain, and perform analytics on customer communications). These service providers are permitted to use the information only for the purpose provided to them and in a manner that is consistent with this Privacy Statement, or any applicable third- party privacy statement. We require our service providers to comply with industry standards around security, retention, and use of any personal information that we provide to them or that they collect on our behalf.

 

Legal Purposes

 

NewsSlide may access, monitor, use, or disclose your personally identifiable information or communications if necessary to comply with the law (for example, to comply with a search warrant, subpoena, or court order); to respond to emergencies; to enforce an agreement with you; to protect our rights or property, or the rights or property of our agents, vendors, service providers, members, and customers; or in the case of a corporate sale, merger, dissolution, or acquisition.


Some of the information that the Service collects is non-personally identifiable that cannot be directly used to identify or reasonably used to identify an individual.

NewsSlide may also take steps to anonymize or aggregate personal information in order to create non-personally identifiable information. This Privacy Statement  does not restrict the disclosure to third parties of non-personally identifiable information.

 

4.                          Data Protection And Security

 

NewsSlide follows generally accepted industry standards to protect the security and confidentiality of information under our control. We maintain safeguards to protect against the loss, misuse, and unauthorized access of your information.

6.                          Notices and Changes to Our Privacy Statement

 

From time to time, we may modify this Privacy Statement. Amendments to this Privacy Statement will be provided and will be effective once provided and accepted. Your continued use of this app and the Service following the provision of any amendment shall constitute your acceptance thereof. If you do not accept the changes, you may not continue using the app and should delete it from your device(s).

 

7.                          Arbitration Agreement

 

If you choose to use any PG Publishing Company products or services, including but not limited to the PG Publishing Company website www.post-gazette.com and PG Publishing Company mobile sites and applications, you agree that that all disputes between you and PG Publishing Company, and all of its parent and affiliate companies, including but not limited to Block Communications, Inc., (“we” or “us”) will be resolved by the provisions in this Arbitration Agreement (these “Provisions”).

 

SCOPE OF MATTERS TO BE RESOLVED BY THESE PROVISIONS. The scope of matters to be resolved by these Provisions is anything related to your relationship with us, which includes (i) the use of any of our services, including the use of our website or websites linked to or through our website and any mobile sites or applications, including any features of the websites, mobile sites or applications; (ii) any contracts with us; (iii) any goods, equipment or items that we sell or otherwise provide you; (iv) any amounts that we charge you for goods or services; (v) any claim based on violation of any rights, regulation, law, or statute, including but not limited to claimed violations of privacy rights; or (vi) any claim that we damaged you or your property. The only matters that are not subject to arbitration are any issues related to our trademarks, service marks, copyrights, or intellectual property. (The scope as defined in this paragraph is referred to below as the “Scope.”)

 

INFORMAL DISPUTE RESOLUTION BEFORE ARBITRATION. Before either of us file any formal procedure against the other, we must first try to resolve the dispute by telephone. If the dispute is not resolved by telephone, you must notify us of the dispute by sending a written description, including your name, address, and telephone number, of your claim to PG Publishing Company, at 2201 Sweeney Dr, Clinton, PA 15026, Attention: Customer Service, so that we can attempt to resolve it with you. You will cooperate with us in providing the information about your claims that we reasonably request. If we do not satisfactorily resolve your claim within 30 calendar days of receiving notice of it, then you may pursue your claim formally pursuant to these Provisions.

 

ARBITRATION. Any dispute or claim within the Scope will be resolved by binding arbitration before one arbitrator, rather than in court, except that either of us may assert claims against the other in small claims court if the claims qualify.

 

ADMINISTRATOR, RULES. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Consumer Arbitration Rules (the “Rules”). The AAA's Rules are available at www.adr.org or by calling 1-800-778-7879. Any disputes related to the existence, validity, or scope of these Provisions shall be resolved by arbitration.

 

HEARING. You may choose whether the arbitration hearing will be conducted in person in Pittsburgh, Pennsylvania, by virtual conferencing applications such as Zoom, or by telephone.

 

INDIVIDUAL ARBITRATIONS ONLY. ANY ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE BASIS OR ACTION.

 

HOW TO FILE AN ARBITRATION DEMAND. To begin an arbitration proceeding, you must send a Demand for Arbitration (“Demand”) to PG Publishing Company, at 2201 Sweeney Dr, Clinton, PA 15026, attention Legal Counsel. The Rules set forth what you need to contain in the Demand. You must also send a copy of the Demand to the AAA by (i) filing at any AAA office, (ii) filing at www.adr.org, or (iii) mailing to American Arbitration Association, Case Filing Services, 1101 Laurel Oak Road, Suite 100, Voorhees NJ 08043. You must also send a copy of these Provisions and the proper filing fee, which is set forth in the Rules.

 

FEES. Payment of all filing, administration and arbitrator fees, and allocation of those fees in any arbitration award, is governed by the AAA's Rules.

 

APPLICABLE LAW. The Federal Arbitration Act governs this arbitration. Except for any state law governing arbitration, the laws of the state of Ohio, without regard to principles of conflict of laws, govern any dispute between you and us.

 

SHORT EXPLANATION OF ARBITRATION. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow the terms of these Provisions.

 

COURT VENUE AND JURISDICTION; JURY WAIVER If for any reason a claim proceeds in court rather than in arbitration, the only place where claims may be brought is courts in Lucas County, Ohio, and you consent to personal jurisdiction and venue in the courts in Lucas County, Ohio. IN ANY COURT ACTION, YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.

 

SURVIVAL. These Provisions continue to apply after the termination of any relationship you have with us.
